1. Acceptance of Terms
Welcome to NovaPath Now ("NovaPath Now," "we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of the NovaPath Now website, related applications, communications, educational materials, and administrative support services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Platform. You must be at least 18 years old and located in the United States to use the Platform.
2. Purpose of the Platform
NovaPath Now is a wellness and administrative support platform that helps connect users with independent licensed healthcare providers and affiliated service partners. NovaPath Now itself does not practice medicine, provide medical advice, prescribe medications, or dispense pharmaceuticals. Medical services available through the Platform are provided solely by independent licensed healthcare professionals and affiliated medical groups. Any medical decisions, diagnoses, treatment plans, prescriptions, or clinical recommendations are made exclusively by those providers in their independent professional judgment.

The content provided on this website is for informational and educational purposes only and is not medical advice.
Nothing on this Platform should be interpreted as: a diagnosis, treatment recommendation, prescription, provider-patient relationship, or substitute for professional medical advice. Always seek the advice of a qualified healthcare provider regarding any medical condition or treatment decision. 4. Telehealth and Provider Services
If you elect to pursue medical treatment through the Platform, you may be connected with independent licensed healthcare providers affiliated with third-party medical groups and telehealth organizations. These providers are solely responsible for: medical evaluations, determining eligibility for treatment, prescribing medications where appropriate, patient monitoring, clinical follow-up, and medical decision-making. NovaPath Now does not control or interfere with provider medical judgment. Not all individuals will qualify for treatment. Prescription products are provided only when clinically appropriate and prescribed by a licensed healthcare provider.
5. Pharmacy Fulfillment
Prescriptions issued by licensed healthcare providers may be fulfilled by licensed third-party pharmacies, including compounding pharmacies where permitted by law. NovaPath Now is not a pharmacy and does not manufacture, compound, dispense, or ship medications. Prescription fulfillment and dispensing services are performed independently by licensed pharmacies selected by the prescribing provider, the patient, or operational pharmacy partners, subject to applicable law and availability. Pharmacy availability, medication inventory, pricing, and shipping timelines may vary and are subject to change without notice.
6. Compounded Medications
Certain medications available through affiliated providers and pharmacies may be compounded medications. Compounded medications: are not FDA-approved, are prepared by licensed compounding pharmacies, may differ from commercially available products, and are prescribed only when determined appropriate by a licensed healthcare provider. You acknowledge that compounded medications have not undergone FDA premarket review for safety, effectiveness, or quality in the same manner as FDA-approved medications.
7. Eligibility
By using the Platform, you represent and warrant that: you are at least 18 years old; you are legally able to enter into binding agreements; all information you provide is truthful and accurate; and you will use the Platform only for lawful purposes. We reserve the right to deny access or terminate accounts at our discretion.
8. User Accounts and Security
You may be required to create an account to access certain services. You are responsible for: maintaining the confidentiality of your login credentials; restricting access to your devices; all activities occurring under your account. You agree to notify us immediately of any unauthorized access or suspected security breach involving your account.
9. Communications and Electronic Consent
By creating an account or using the Platform, you consent to receive electronic communications from NovaPath Now and our affiliated providers, including emails, push notifications, and text (SMS) messages.
SMS/Text Messaging Terms:
- Usage & Frequency: Text messages are used to deliver administrative updates, booking confirmations, appointment reminders, operational notices, and promotional marketing offers. Message frequency varies based on your interaction with the Platform.
- Rates: Message and data rates may apply from your mobile carrier.
- Opt-Out: You can cancel the SMS service at any time. Just text STOP, END, CANCEL, UNSUBSCRIBE, or QUIT in response to any message. After you send the SMS message choosing to opt-out, we will send you an SMS message to confirm that you have been unsubscribed.
- Support: If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly through the contact options on our Platform.
10. Payments and Subscriptions
Certain services may require payment. By providing a payment method, you authorize NovaPath Now and its payment processors to charge applicable fees, including recurring subscription fees if applicable. Program pricing, billing frequency, cancellation terms, and renewal policies will be disclosed at checkout or during enrollment. Unless otherwise stated: services are cash-pay only, insurance is not billed, reimbursement through insurance, HSA, or FSA is not guaranteed. Failure to maintain valid payment information may result in suspension or cancellation of services.
11. Refund Policy
Due to the personalized nature of healthcare-related services and prescription fulfillment, all sales are generally final unless otherwise required by law or expressly stated in a separate Refund Policy. Prescription medications that have been dispensed or shipped are not eligible for return or refund.
12. Intellectual Property
All content on the Platform, including text, graphics, logos, branding, educational materials, website design, software, images, and functionality is owned by NovaPath Now or its licensors and protected by intellectual property laws. You may not reproduce, distribute, modify, copy, republish, or commercially exploit any content without prior written permission.
13. Prohibited Conduct
You agree not to: use the Platform unlawfully; impersonate another individual; interfere with website functionality; attempt unauthorized access to systems or data; transmit malware or harmful code; scrape or copy website content; misuse provider or pharmacy services. We reserve the right to suspend or terminate accounts for violations of these Terms.
14. Third-Party Services and Links
The Platform may contain links to third-party websites, providers, pharmacies, payment processors, or external services. NovaPath Now does not control or endorse third-party websites or services and is not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms and conditions.
15. Disclaimer of Warranties
THE PLATFORM AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, NOVAPATH NOW DISCLAIMS ALL WARRANTIES, INCLUDING: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.
We do not guarantee: uninterrupted access, error-free operation, treatment outcomes, medication availability, or suitability of services for any individual.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVAPATH NOW AND ITS AFFILIATES SHALL NOT BE LIABLE FOR: indirect, incidental, consequential, punitive, special, or exemplary damages arising from your use of the Platform or services accessed through the Platform. Our total aggregate liability shall not exceed the greater of: (a) $100; or (b) the amount paid by you to NovaPath Now during the twelve (12) months preceding the claim.
17. Indemnification
You agree to indemnify and hold harmless NovaPath Now, its affiliates, officers, directors, employees, contractors, providers, pharmacy partners, and service providers from any claims, liabilities, damages, or expenses arising from: your misuse of the Platform; violation of these Terms; violation of applicable laws; or misuse of medications or treatment services.
18. Governing Law
These Terms shall be governed by the laws of the State of Illinois, without regard to conflict-of-law principles.
19. Arbitration Agreement
Any dispute arising from these Terms or your use of the Platform shall be resolved through binding individual arbitration and not through court proceedings or class actions. You waive the right to: participate in class actions, class arbitrations, jury trials, and representative proceedings. Arbitration shall be conducted in Illinois unless otherwise required by law.
20. Changes to Terms
We may update these Terms from time to time. Updated Terms become effective upon posting to the Platform. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
21. Geographic Availability
NovaPath Now currently facilitates access to services in all fifty (50) United States and Washington, D.C.; however, certain products, medications, treatments, or services may not be available in all jurisdictions or to all individuals. Availability is subject to provider licensure, pharmacy limitations, medical appropriateness, and applicable federal and state laws and regulations, and may change without notice.
